License Agreement

1. Introduction

This License Agreement ("Agreement") governs your use of the educational course content, materials, videos, and related resources (collectively, "Course Content") provided by Locomotio ("we," "our," or "us") through our bodyflying education platform.

By purchasing, accessing, or using any Course Content, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, you must not access or use the Course Content.

2. Grant of License

Subject to your compliance with this Agreement and payment of applicable fees, Locomotio grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Course Content for your personal, non-commercial educational purposes.

2.1 License Scope

  • This license is personal to you and may not be shared, transferred, or assigned to any other person or entity
  • The license is non-exclusive, meaning we may grant similar licenses to other users
  • Access is granted for the duration of your active yearly membership period, unless terminated earlier in accordance with this Agreement
  • You may access Course Content on multiple personal devices for your own use during your membership period

2.2 License Duration

Your license to access Course Content is granted for a one-year period from the date of purchase. Access will continue for the duration of your active yearly membership, subject to:

  • Your continued compliance with this Agreement
  • Maintenance of an active, paid membership
  • Renewal of your membership upon expiration (if you choose to renew)

Your access to Course Content will terminate if:

  • Your yearly membership expires and is not renewed
  • Your account is terminated for violation of this Agreement
  • We discontinue the Course Content or platform (with reasonable notice)
  • You request account deletion or cancellation

3. Permitted Uses

You may use the Course Content for the following purposes:

  • Personal Learning: Accessing and viewing Course Content for your personal education and skill development in bodyflying
  • Personal Practice: Applying the techniques and concepts learned from the Course Content in your personal bodyflying practice
  • Note-Taking: Taking personal notes, summaries, or annotations for your own learning purposes
  • Multiple Devices: Accessing Course Content on your personal devices (computers, tablets, smartphones) for your own use
  • Offline Viewing: Temporarily caching Course Content on your device for offline viewing, provided such caching is done through normal platform functionality

4. Prohibited Uses

You are expressly prohibited from the following activities:

4.1 Account and Access Restrictions

  • Sharing your account credentials (username, password, or access tokens) with any other person
  • Allowing others to access Course Content through your account
  • Creating multiple accounts to circumvent access restrictions or pricing
  • Using automated tools, bots, or scripts to access or download Course Content

4.2 Content Distribution and Sharing

  • Downloading, copying, saving, or storing Course Content (videos, text, images, PDFs) outside of the platform
  • Redistributing, sharing, or making Course Content available to others, whether for free or for payment
  • Uploading Course Content to file-sharing services, video platforms, or any other public or private repository
  • Streaming, broadcasting, or publicly displaying Course Content
  • Sharing screenshots, screen recordings, or transcripts of Course Content

4.3 Commercial and Derivative Uses

  • Using Course Content for any commercial purpose, including but not limited to teaching, training, or coaching others
  • Reselling, renting, or licensing Course Content to third parties
  • Creating derivative works based on Course Content, including summaries, adaptations, or translations
  • Using Course Content to create competing educational products or services
  • Extracting, reverse engineering, or attempting to extract the underlying structure, methodology, or techniques from Course Content

4.4 Other Prohibited Activities

  • Removing, altering, or obscuring copyright notices, trademarks, or other proprietary markings
  • Using Course Content in any way that violates applicable laws or regulations
  • Using Course Content in a manner that could damage Locomotio's reputation or business

5. Intellectual Property Rights

All Course Content, including but not limited to videos, text, images, graphics, audio, software, and other materials, is the exclusive property of Locomotio or its licensors and is protected by copyright, trademark, and other intellectual property laws.

5.1 Ownership

Locomotio retains all rights, title, and interest in and to the Course Content. This Agreement does not grant you any ownership rights in the Course Content. You acknowledge that:

  • All Course Content is proprietary and confidential
  • You have no right to copy, modify, distribute, or create derivative works from Course Content
  • Any unauthorized use of Course Content constitutes infringement of our intellectual property rights

6. User-Generated Content

When you upload videos, images, or other content ("User Content") to our platform as part of course tasks or assignments:

6.1 Your Rights

You retain ownership of your User Content. However, by uploading User Content, you grant Locomotio a worldwide, non-exclusive, royalty-free license to:

  • Store, host, and display your User Content on our platform
  • Use your User Content for course administration and educational purposes
  • Use anonymized or aggregated User Content for platform improvement and analytics

6.2 Use in Course Materials and Marketing

With your explicit permission, we may use your User Content in:

  • Course materials and examples (with attribution, if desired)
  • Marketing materials, testimonials, or promotional content
  • Social media posts and website content

We will always request your permission before using your User Content for marketing purposes, and you may revoke this permission at any time.

6.3 Your Responsibilities

You represent and warrant that:

  • You own or have the right to upload and license your User Content
  • Your User Content does not infringe on any third-party rights (copyright, privacy, etc.)
  • Your User Content complies with applicable laws and does not contain illegal, harmful, or offensive material

7. Account Terms

Your access to Course Content is tied to your account. The following terms apply:

  • One Account Per Person: You may maintain only one active account. Creating multiple accounts to circumvent restrictions is prohibited
  • Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account
  • Account Sharing Prohibited: You may not share your account with others or allow others to access Course Content through your account
  • Account Transfer: Accounts and licenses are non-transferable. You may not transfer your account or access rights to another person

8. Payment and Refund Policy

Course Content is provided on a paid basis. The following terms apply to payments and refunds:

8.1 Payment

  • Membership fees are specified at the time of purchase and are charged on a yearly basis
  • All fees are in EUR (or as otherwise specified)
  • Payment must be made in full before access to Course Content is granted
  • Your yearly membership begins on the date of purchase and expires one year from that date
  • We reserve the right to change pricing at any time, but changes will not affect memberships already purchased
  • Membership renewal (if you choose to renew) will be at the then-current pricing

8.2 Refunds

Refund Policy:

  • No refunds after purchase (digital content policy)
  • Refunds within 14 days of purchase if you have not accessed more than 10% of the course content
  • Refunds on a case-by-case basis for technical issues or other valid reasons

9. Termination

This Agreement and your license to access Course Content may be terminated in the following circumstances:

9.1 Termination by You

You may terminate this Agreement at any time by deleting your account. Upon account deletion, your access to Course Content will be revoked, and your account data will be deleted in accordance with our Privacy Policy.

9.2 Termination by Us

We may terminate or suspend your account and access to Course Content immediately, without prior notice, if:

  • You breach any term of this Agreement
  • You engage in prohibited uses of Course Content
  • You violate our Terms of Service or Community Guidelines (if applicable)
  • We determine, in our sole discretion, that your use of the platform poses a risk to us or other users

9.3 Effect of Termination

Upon termination:

  • Your right to access and use Course Content will immediately cease
  • You must immediately stop using and delete any downloaded or cached Course Content
  • All provisions of this Agreement that by their nature should survive termination will survive, including intellectual property rights, disclaimers, and limitations of liability
  • No refunds will be provided for termination due to your breach of this Agreement

10. Limitation of Liability and Disclaimers

10.1 Educational Content Disclaimer

The Course Content is provided for educational and informational purposes only. While we strive to provide accurate and up-to-date information, we make no representations or warranties regarding:

  • The accuracy, completeness, or reliability of Course Content
  • That Course Content will meet your specific needs or expectations
  • Any particular results or outcomes from following Course Content

10.2 Safety Disclaimer

IMPORTANT SAFETY WARNING: Bodyflying (indoor skydiving) is a physical activity that involves inherent risks of injury or death. By using Course Content, you acknowledge and agree that:

  • You participate in bodyflying activities at your own risk
  • You are responsible for your own safety and the safety of others
  • You should always follow safety guidelines and instructions from qualified instructors at wind tunnel facilities
  • Course Content is not a substitute for proper instruction, supervision, and safety equipment
  • Locomotio is not responsible for any injuries, damages, or losses resulting from your use of techniques or concepts learned from Course Content
  • You should consult with medical professionals before engaging in physical activities if you have health concerns

10.3 Limitation of Liability

To the maximum extent permitted by law, Locomotio and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, or business opportunities
  • Personal injury or property damage
  • Any damages resulting from your use or inability to use Course Content

Our total liability for any claims arising from this Agreement or your use of Course Content shall not exceed the amount you paid for the Course Content in the 12 months preceding the claim.

10.4 No Warranties

Course Content is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Indemnification

You agree to indemnify, defend, and hold harmless Locomotio and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of Course Content
  • Your violation of this Agreement
  • Your violation of any third-party rights
  • Any User Content you upload to the platform
